What is Professional Tax Registration ?
Professionals covered include all kind of business like VAT Registered dealers, establishment registered under Shop & Establishment, Employers of Establishments having Employee base, Practicing professionals like CA, CS, Doctors, Architects, lawyers, Real Estate Builders and so on.
Different states have different rates and methods of collection. The states which impose professional tax are Andhra Pradesh, Assam, Chhattisgarh, Gujarat, Karnataka, Kerala, Maharashtra, Madhya Pradesh, Meghalaya, Orissa, Tripura, Sikkim, Tamil Nadu, Telangana, and West Bengal.
In case of Salaried Employees, Professional Tax is deducted from the salary of the employees by the employers and same is deposited with the State Government by Employer under PTRC Registration.
In other cases, Every professional person or trade is required to pay on their own Profession Tax liability annually at fixed Rates falling under Professional Tax Enrollment Certificate (PTEC).
Employer is also required to file Monthly / Annual Professional Tax Return (depends upon liability prescribed) specifying Details of Employees, Salaries and Profession tax deducted.
The tax amount of professional tax paid during the year is allowed as Deduction under the Income Tax Act.
Important Points to remember for Professional Tax
It is a mandatory requirement prescribed by State Govt. under Muncipal Laws and needs to be followed by every person who falls within the categories prescribed.
The rate of professional tax charged is based on the Income Slabs set by the respective State Governments. However, Annually Tax amount is kept at nominal fixed amounts by state govt.
Professional Tax must be deposited by latest by 15th of following Month for PTRC and returns to be filed Monthly/ Annually based on liability prescribed. In case of PTEC, Professional tax must be deposited by 30th June of every financial year.
State laws have prescribed heavy penalty and prosecutions ranging from per day fine in case of Non-Registration/Payment for past dues.
