What is Goods and Service Tax (GST) ?

GST is a One Nation Tax, introduced during FY 2017-18 and which subsumes the variety of state and central indirect taxes namely Excise, VAT, CST, Service Tax, Entertainment Tax, Luxury Tax, Octroi.
GST is a Single Common Tax for Supply of Goods and services, right from the manufacturer to the end consumer.
The Input tax credit paid at each stage will be available for set-off against output tax liability on subsequent stage, thus which makes GST tax only on value additions at each stage and avoid double taxations.
It is the end consumer who bears the GST charged by the last dealer in the supply chain, with set-off benefits available in all the previous stages of supply.
Entire procedure for GST Registration, Compliances and filings is completely on-line, where every registered dealer is expected to communicate with govt. in online mode only which essentially brings in ease of doing business and reduced compliance cost.

GST Registration Requirements

GST is applicable to all types of Indian business who are Manufacturer, Trader, Importer, Reseller, Service Provider, Freelancer and professionals engaged in supply of goods and/or services.
GST Registration is mandatory for all types of business entities prescribed above whose supply Turnover crosses Rs.20 Lacs. There will also be a Composition scheme under GST for business with a supply turnover not exceeding Rs.50 Lacs, which will benefit small business with reduced compliances.
Dealer is required to obtain GST registration in each state from where supply of goods or services will be effected in the course of business, to avail complete benefit of input tax credit paid on purchases and input supplies.
For New dealers who do not hold any existing registration of VAT/Excise or Service Tax, Govt. will announce dates by which new registration will be issued.

GST Migration for Existing Dealers

All existing dealers who are registered under any of the Act ( VAT, CST, Excise, Service Tax) are required to apply for GST migration. Govt. has given provisional GST allotment IDs to all the existing registered dealers. For Migration, Online application to be submitted with GST portal along-with necessary supporting documents as prescribed.
On successful migration application, Govt. allots GSTN Provisional Registration Number (Unique Alpha-numeric Number), which is identification of dealer under GST regime and same will be active on beginning of GST in India. This will remain in force until the business is discontinued or GST Registration number is cancelled for defaults.

Important Features of GST

GST will be Single Common tax applicable to whole of India on all type of Goods and Services. It will replace and consolidate Central Excise Duty, Service Tax, VAT, Central Sales Tax, Customs Duty, Central Surcharge & Cess, Octroi, Luxury Tax, Entertainment Tax, Purchase Tax and a few other indirect taxes.

GST will have a Central component (Central Goods and Services Tax or CGST) and a state component (State Goods and Services Tax or SGST). Therefore, centre and state will levy GST on all entities. Inter-state transactions will attract the Integrated Goods and Services Tax (IGST), to be levied by the centre. Thus for every Local Supply within the state both CGST and SGST is required to be charged by the dealers, while in case of Supply outside state IGST will have to be charged.

GST Council is the apex body to decide on rates and structure of GST. Currently, GST Rates have been classified under 4 tier tax slabs i.e. 5%, 12% 18% and 28% for different goods and services. Final GST Rate depends upon nature of goods or services supplied by the business as per classification given by GST Council.

For the benefit of Small Business, GST has prescribed Composition Scheme for those dealers whose turnover of supply is less than Rs.50 Lacs during financial year. Under Composition Scheme, dealer is required to pay GST at nominal flat rates not below 1%. Such business cannot collect tax from their customers. Thereby, ensures ease of doing business with reduced cost of compliances for small and medium enterprises.

The Business must obtain GST Registration, if the turnover of their supply during financial year crosses Rs. 20 lakh. Supply with its wider scope covers all forms of supply including stock transfers, free supplies, exempt goods sales etc. Further, In case of inter-state supply by business, registration is mandatory under GST irrespective of Turnover limits.
Only after registration, dealer can start collecting GST on all the supply effected by them and avail inputs paid on purchases.

If supply of goods or provision of service is made outside India or exported from India, GST is not applicable.

Input Tax Credit for GST paid on Purchase of Goods and services for business purpose is allowed to be set-off against Output GST liability on Supply turnover made by the dealer. Thus, reducing double taxation impact and every subsequent sale is tax neutral for the dealer.

As GST is paid by purchaser and gets off-set against GST payable on Sales. Effectively, it is the end consumer who bears the GST burden as accumulated GST is being embedded in the final retail sale price charged to end consumers. Business only pays GST on the value-add/ margins of the goods.
